1. About these terms

FitX AI is a fitness and nutrition tool: workout planning and logging, training targets, body measurements, food logging and meal planning. It is offered by Srihari Thoutu, an individual based in Melbourne, Victoria, Australia (“FitX AI”, “we”, “us”).

These terms are an agreement between you and us about your use of FitX AI. When you create an account, or when we change these terms, you are asked to accept them and to confirm you have read our Privacy Policy. Reading these pages does not by itself mean you have accepted anything. If you do not accept them, do not use FitX AI: you can sign out, or delete your account, from the acceptance screen.

2. Who can use FitX AI

You must be at least 13 years old. If you are under 18, use FitX AI with the knowledge of a parent or guardian. An account is for one person. Give us accurate information when you sign up, including your age, and keep it up to date, because your plan and targets are worked out from it.

3. Your account

You sign in with a Google account or an Apple ID. We never see or store your Google or Apple password. You are responsible for the security of that account and for what happens under your FitX AI account. Tell us promptly at fitxai.app@gmail.com if you think someone else has accessed it.

4. What FitX AI is, and is not

FitX AI gives general fitness and nutrition information and tools. It works out workout targets, calorie and protein targets and meal plans from the answers and records you give it, using FitX AI’s own rules, which run in the app. Your information is not sent to an artificial-intelligence service to produce them.

FitX AI is not a medical, dietetic or physiotherapy service. It does not diagnose, treat or prevent any condition and does not replace advice from a qualified professional who knows your circumstances. Check with a health professional before starting an exercise or nutrition program, especially if you have an injury or a health condition. Stop if something hurts. Targets and suggestions are estimates. They can be wrong or unsuitable for you, and results vary. We do not promise any particular result.

5. Acceptable use

You agree not to use FitX AI unlawfully or to harm or defraud anyone; access or try to access another person’s account or data; interfere with the security or operation of FitX AI; use automated means to access it in a way that overloads it; or copy, resell or republish its software or content except as the law allows.

6. Your information

Your workout logs, measurements, food logs, notes and other information you enter remain yours. You permit us to store, process and show them as needed to run FitX AI for you, including syncing them between your devices. What we do with personal information is set out in the Privacy Policy. You can download your data and delete your account at any time (Profile, then Download my data or Delete account in the apps and the web app).

7. Our content and software

FitX AI’s software, design, text and other material are owned by us or our licensors and protected by law. We give you a personal, non-exclusive, non-transferable permission to use FitX AI as provided. Research pages summarise published studies in our own words and link to the originals, which belong to their authors and publishers. Food values come from USDA FoodData Central (public domain) and may be adjusted for display

8. Third-party services

FitX AI relies on services run by others, mainly Google (Firebase Authentication and Cloud Firestore for sign-in and storage, Google Sign-In, Google Fonts) and, on iPhone, Apple (Sign in with Apple). Their terms and privacy policies apply to what they do.

9. Availability and changes

We aim to keep FitX AI available but do not promise it will be uninterrupted or error-free. We may change, add or remove features. Keep your own copy of anything you cannot afford to lose: you can download your data in the apps.

10. Fees

FitX AI is currently free and takes no payments. If we add paid features we will tell you the price and billing terms before you pay anything.

11. Ending your use

You can stop using FitX AI at any time and delete your account. We may suspend or end access if you seriously or repeatedly break these terms, if we must by law, or to protect FitX AI or other people. Where it is reasonable to, we will tell you why and give you the chance to download your data first. If we end the service as a whole we will give reasonable notice.

12. Deleting your account

Deleting your account erases your FitX AI data and your FitX AI sign-in; it does not delete your Google account or Apple ID. What is erased, and anything kept, is set out in the Privacy Policy and on the account deletion page. Your record of accepting these terms is erased with the rest of your account.

13. Your legal rights, warranties and liability

Our services come with guarantees under the Australian Consumer Law that cannot be excluded. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified. If a consumer guarantee is not met, you may be entitled to a repair, replacement or refund and to compensation for reasonably foreseeable loss. Subject to that, and to the extent the law allows, FitX AI is provided “as is”, and where the law allows us to limit our liability for a failure to meet a consumer guarantee, it is limited, at our choice, to supplying the service again or paying the cost of having it supplied again. Nothing in these terms limits liability for fraud, or for death or personal injury caused by our negligence, where the law does not allow it

14. Support and complaints

For help or to make a complaint, contact us at fitxai.app@gmail.com. We will acknowledge your message and respond as soon as we reasonably can.

15. Changes to these terms

We may update these terms. The version and date are at the top of this page. For a change that matters we will tell you in the app and ask you to accept the new version before you continue using your account; other changes take effect when posted. Earlier versions are available on request.

16. Governing law and disputes

These terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts that hear appeals from them, in each case subject to any consumer rights that cannot be excluded. Please contact us first if you have a dispute so we can try to resolve it informally

17. General

If part of these terms is unenforceable, the rest still applies. These terms, with the Privacy Policy, are the whole agreement between you and us about FitX AI. Not enforcing a right is not giving it up.
